Checkmate for Brands Privacy Notice

Thank you for being part of our community at Checkmate for Brands, a division of Checkmate Intelligence, Inc. ("Checkmate", "we", "us", "our"). This Checkmate for Brands Privacy Notice (the "Privacy Notice") sets out how we collect, process, and license personal information to help online businesses (our "Customers") with their advertising, marketing, and communications efforts (our "Brands Services"). Most importantly, we provide you with choices to exercise your privacy rights under applicable laws by following the instructions below.

Your Privacy Choices

As of the date of the posting of this Privacy Notice, the following states have specific data privacy rights: California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia. These rights may include:

  • The Right to Know or Access. You may have the right to receive a copy of the personal information we maintain about you.
  • The Right to Correct. You may have the right to correct any personal information inaccuracies we maintain about you.
  • The Right to Delete. You may have the right to delete the personal information we maintain about you.
  • The Right to Opt Out of 'Sales' or 'Shares'. You may have the right to request that we cease to 'sell' or 'share' your personal information for third party targeted or cross-contextual behavioral advertising purposes.

For requests to access, correct, or delete your personal information, please be prepared to provide information that will help us verify your identity. Note, we reserve the right to refuse any request that may not be available to you under the laws of where you live, if we cannot verify your identity, or for any other reason permitted under law. Any information we provide to you as part of a 'Right to Know' or 'Right to Access' request will be in a readily usable format (a.k.a. for 'portability' purposes). We also reserve the right to require additional legal information from any business or individual purporting to be an 'agent' of another person, unless we are prohibited by law or regulation from doing so. Please note that we do not sell, license, or otherwise provide data to companies engaged in making material decisions about an individual's reputation to help determine credit worthiness, employment, or housing. Our Customers are primarily online businesses that use licensed data to advertise their products and services.

The Brands Services are not directed to individuals who are under age of eighteen (18), nor knowingly collect personal information from children under the age of eighteen (18). If you believe that we have unknowingly collected any personal information from someone under the age of eighteen (18), please contact us immediately at privacy@checkmateforbrands.com and the information will be deleted.

The Categories of 'Sensitive' Personal Information We Sell or License

We do not collect, sell or license 'sensitive' personal information as defined by applicable privacy laws.

The Categories of Third Parties with Which Personal Information is Sold or Shared

We sell or share personal information to our Customers and other third parties in the following categories:

  • Advertising and marketing services, including for programmatic advertising
  • Business services such as advertising agencies and data services
  • Product sellers such as ecommerce, retail and consumer packaged goods
  • Travel and tourism (for example, cruise lines, hotels, online travel services)

The Purposes for Our Brand Service Use of Sold or Licensed Personal Information

We may use personal information to identify prospective advertising and marketing audiences for our Customers, and improve our ability to match users, devices and browsers together.

Our Customers generally use personal information for advertising and marketing, including direct marketing and interest-based, targeted or 'cross-context behavioral' advertising.

The Categories of Personal Information Disclosed to Service Providers or Contractors for a Business Purpose

We may disclose the following categories of personal information to service providers and contractors:

  • Cloud computing and storage vendors
  • Security service providers or contractors
  • Consultants
  • Measurement and analytics providers
  • Advertising and marketing service providers

Other Disclosures

We also may disclose any of the personal data we process for the following purposes:

  • For Legal Purposes. We may disclose personal information in order to comply with legal process or a regulatory investigation, enforce our legal terms or contracts, protect the rights, property or personal safety of us, our platform, our customers, our agents and affiliates, its users and/or the public, including against fraud or security incidents.
  • In the Event of a Corporate Transaction. We may disclose personal information in the event of a corporate transaction, including for example a merger, investment, acquisition, reorganization, consolidation, bankruptcy, liquidation, or sale of some or all our assets, or for purposes of due diligence connected with any such transaction.
  • With Service Providers. As noted above, we may disclose any personal information with our service providers, which may include (for instance) providers involved in tech or customer support, operations, web or data hosting, billing, accounting, security, marketing, data management, validation, enhancement, or hygiene, or otherwise assisting us to provide, develop, maintain, and improve our Brands Services.

Retention of Sold or Licensed Personal Information

We will keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this notice will require us to keep your personal information for longer than three (3) months past the termination of the user's account.

Please note that following a request to delete your personal information, we may retain a record of the deletion request for the necessary purpose of ensuring that the information remains deleted and is not used for any other purpose.

How We Keep Your Information Safe

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from the Brands Services is at your own risk. You should only access the Brands Services within a secure environment.

If you are an 'authorized agent', you must provide in your web form submission a copy of the authorization signed by the authorizing consumer in order to exercise rights on their behalf.

Cookies and Other Tracking Technologies

Like many companies, we use cookies, pixels, and other tracking technologies to collect information about your browsing activities, your interactions with our websites or emails, and to serve tailored ads on third party media websites or on behalf of our advertisers through other websites. There are a number of ways to opt out of having your online activity and device data collected through these Checkmate for Brands Services for our advertising purposes, which we summarize below.

  • Advertising Industry Opt-Out Tools. You can also use these opt-out options to limit use of your information for interest-based advertising online or in apps by visiting http://optout.aboutads.info for U.S. residents, and https://www.youronlinechoices.ca for Canadian residents.
  • With Each of Our Vendors Individually. The following advertising or marketing service partners offer opt-out features that let you opt-out of use of your information for interest-based advertising or profiling.

Please note that because these opt-out mechanisms are specific to the device or browser on which they are exercised, you will need to opt out on every browser and device that you use.

Appeal Your Privacy Rights

If we deny your privacy request after your submission, you may appeal that decision by emailing us at privacy@checkmateforbrands.com. If you are still unsatisfied with our response, you may have the right to file a complaint with your state attorney general.

International Visitors

Checkmate primarily operates and stores personal information in the United States. While we welcome international business customers to use our Brands Services, we do not intentionally collect, use or sell personal information associated with individuals whose residence is outside of the United States at this time.
